II. Statutory Warranty
1. From the purchase of the goods 2 (two) years from the purchase of the goods, if the goods are found to be defective, the consumer has the right to require the merchant to remedy the defect (repair or replacement of the goods at no cost, a price reduction) or to withdraw from the contract.
2. An item is considered defective if it has a defect that it could have had before the sale and that did not arise from the use of the item, including improper use by the consumer.
3. Repair and replacement of goods are the consumer's primary rights. The consumer has the right to demand that the merchant repair or replace the goods free of charge, unless this is, given the nature of the goods, impossible or would require an unreasonable or disproportionately large expense.
4. The consumer has the right to request a reduction in the price of the goods or to cancel the contract if one of the following conditions exists:
The product cannot be repaired or replaced;
The merchant did not repair or replace the goods within a reasonable time, and the consumer has lost interest in the performance of the contract;
repairing or replacing the goods by the merchant would cause a significant inconvenience to the consumer;
5. The consumer is not entitled to rescind the contract if the defect in the goods is minor.
6. The scope of the statutory warranty applies within the territory of Georgia.
7. Matters not provided for in these warranty conditions shall be governed in accordance with the Law of Georgia on Consumer Rights Protection.
8. The statutory warranty does not apply to entrepreneurs/legal entities.

III. Burden of Proof
If the consumer discovers a defect in the goods within 6 months of taking possession of the goods, Until proven otherwise, it is presumed that the defect existed at the time of delivery of the goods, if, given the nature of the goods or the character of the defect, this is possible. In this case, the burden of proof lies with the trader. If the consumer discovers a defect in the goods more than 6 months after taking possession of them, the burden of proof that the defect existed at the time of delivery rests with the consumer;

IV. Commercial Warranty:
The purchased item is subject to the merchant's individual warranty conditions, which do not limit the consumer's rights established by law.;
2. Under the Commercial Warranty, a defective Apple-branded iPhone will be unconditionally replaced within the first 1 (one) year from the date of purchase, provided the defective product is not visually damaged. (the so-called "Replacement Warranty").
The defect must be confirmed based on the service center's conclusion.
3. An item purchased in-store will be replaced unconditionally on the same day of purchase if a visual/visible defect is discovered immediately upon opening the item in the store (i.e., upon removal from the box). A representative of the merchant must be present during the inspection of the purchased item's visual condition.

V. Risk of accidental death
1. Upon the transfer of the sold goods to the customer, the risk of their accidental loss or damage passes to the customer.
2. If the purchased item is to be shipped to the consumer, the risk passes to the consumer at the moment when the consumer or a third party authorized by the consumer (other than the carrier) acquires actual possession of the goods.
3. If the sold item is shipped by the carrier at the consumer's request, the risk of accidental loss or damage to the item passes to the consumer from the moment the item is delivered to the carrier.

VI. Service Center Service
In the event a defect is found in the item, and to obtain a legal or commercial warranty, the item must be submitted to the merchant's partner service center for diagnosis.
2. The service center's service times are:
Diagnosis – 3-7 business days;
Repair or replacement of an item – 15 business days, if the appropriate item and/or replacement part is in stock.
Repair or replacement of the item – 40 business days, if the corresponding item and/or replacement part needs to be ordered from abroad.
Weekends and holidays provided for by Georgian legislation are not included.
3. Warranty service will be provided if the service center confirms, based on a relevant conclusion, that the defect in the item is inherent and did not result from the item's use, including improper use by the customer.
4. If the customer refuses to leave the item at the service center for diagnostics and/or repair, the merchant will be unable to perform the warranty service.

VII. Conditions for Denial of Warranty Service
Warranty service does not apply to or is voided for the item or any part of its configuration in the following cases:
The warranty period has expired.;
2. A proof of purchase is not provided and the item cannot otherwise be identified;
3. The warranty card is not presented / is lost and the item cannot otherwise be identified;
4. The serial number / IMEI code on the item is illegible or has been removed, and therefore it is impossible to identify the product.;
5. Damage caused by the removal of the seal or cap;
6. The defect is caused by mechanical damage to the device;
7. The device was used for a purpose other than its intended use, which caused damage to the item;
8. The device has been disassembled for unauthorized repair or any other purpose, resulting in damage to the item;
9. Damage is caused by a computer virus or incompatible files;
10. Damage caused by the intrusion of a foreign body or liquids into the mechanism;
11. The device was used for commercial purposes;
12. The fault is caused by a malfunction in the power grid;
13. Damage caused by a violation of the rules and conditions of use and storage;
